China Tightens Export Control Query Process for Dual-Use Items: What Foreign Founders Need to Know
China's Ministry of Commerce and General Administration of Customs issued Announcement No. 52 of 2026, refining the procedures for querying and identifying dual-use items in export controls. The new rules set clear timelines, documentation requirements, and compliance obligations for exporters, effective immediately. Foreign founders operating in China should understand these changes to avoid shipment delays and ensure compliance.
New Export Control Query Rules for Dual-Use Items
On October 19, 2026, China's Ministry of Commerce (MOFCOM) and the General Administration of Customs (GAC) jointly released Announcement No. 52 of 2026, aimed at optimizing the query and identification process for dual-use items under export control. The announcement, effective immediately, replaces the previous GAC Announcement No. 123 of 2025. For foreign founders running businesses in China that involve exports of potentially controlled goods, these changes introduce clearer procedures and stricter timelines that demand attention.
What Are Dual-Use Items?
Dual-use items are goods, technologies, and services that can be used for both civilian and military purposes, or that may contribute to weapons of mass destruction. China's export control regime requires exporters to obtain licenses for such items. The new announcement focuses on the query process when customs suspects that an export shipment may fall under dual-use controls but the exporter has not presented a required license.
Key Changes and Requirements
1. Customs Query and Notification
If an exporter declares goods for export without presenting a MOFCOM-issued export license, and customs has evidence suggesting the goods may be dual-use controlled, customs will issue a Customs Query Notice for Dual-Use Items Export Control (Attachment 1). This formal notice triggers a response obligation for the exporter.
2. Exporter's Documentation Obligations
Upon receiving the query notice, the exporter must submit the following materials within 7 working days, all stamped with the company seal. If documents are in a foreign language, a Chinese translation must also be provided:
- Customs declaration form, export contract, invoices, and transport documents proving the flow of goods;
- A statement explaining the goods' performance indicators, main uses, and legal and factual reasons why the exporter believes the goods are not subject to export control;
- Technical documentation proving the nature of the goods (including test reports, if available);
- Any other required materials.
3. Customs Assessment and MOFCOM Identification
After receiving the exporter's materials, customs will assess the case. If necessary, the GAC may request MOFCOM to organize an expert identification. Based on the outcome, customs will issue a Customs Query Result Notice (Attachment 2) and handle the case as follows:
- If the goods are not dual-use, customs clearance continues;
- If the goods are dual-use, they will be handled according to relevant regulations;
- Other situations will be dealt with as required.
4. Timelines for Assessment and Identification
Customs will complete its assessment or submit a request to MOFCOM within 15 working days from receiving all required materials. MOFCOM will then issue an identification conclusion within 15 working days from receiving complete materials for identification. Time spent by the exporter submitting or supplementing materials, and time for inspection and testing of the queried goods, is not counted toward these deadlines. For major or complex cases, these time limits may be extended.
5. Goods Not Released During Query
During the query and identification period, customs will not release the goods. However, if the exporter requests to split off other goods under the same customs declaration that are unrelated to the queried goods, customs may, after evaluation and approval, allow separate customs clearance for those goods.
6. Compliance and Truthfulness
Exporters must provide truthful and reliable information and supplement materials as required. They must not refuse, obstruct, conceal, or provide false information during the query, identification, or related processes.
7. Coverage of Other Channels
The announcement also applies to exports of dual-use items through cross-border e-commerce, passenger carry-on, mail, and express channels.
8. Interpretation and Implementation
MOFCOM and the GAC are responsible for interpreting the identification and query work respectively. The announcement takes effect on the date of publication, and the previous GAC Announcement No. 123 of 2025 is simultaneously abolished.
Practical Implications for Foreign Founders
For foreign entrepreneurs operating export-oriented businesses in China, these new rules underscore the importance of proactive compliance. If your company ships goods that could be considered dual-use, ensure you have the necessary licenses before declaration. If you receive a customs query notice, act swiftly to gather the required documents within the 7-working-day window. Delays or incomplete submissions can lead to shipment holds and potential penalties. Understanding the timelines and obligations can help you avoid disruptions and maintain smooth operations.
